9. Product Orders
9.1 The Hugovitamin Company sells its branded nutritional and supplement products to consumers on hugovitamin.com and through Hugovitamin independent sales partners.
9.2 Any order received by Hugovitamin in accordance with clause 10.1 below is accepted by Hugovitamin at its own exclusive discretion. The order is accepted and the contract with you, the customer, is finalized when you receive a confirmation email from Hugovitamin and/or you receive the products ordered.
9.3 Recurring orders are defined as continuous, on-going orders that have been expressly agreed to by you, the customer, and involve recurring deliveries on an agreed-to schedule.
9.4 In the event that you submit a recurring order, this contract is entered into for an indefinite period of time with both you and Hugovitamin having the right to cancel. If you cancel a recurring order in the middle of a payment cycle, all remaining payments for your canceled order will be processed at their regularly scheduled time, unless prearrangements have been made. Orders must be canceled within seven (7) calendar days of your recurring ship date to prevent the next shipment and the charge to your payment method.
9.5 Before an order is submitted, you have the right to choose between the option of a making a single full payment or agreeing to pay in 4 (four) monthly installments. Hugovitamin retains the right to refuse an order payment in installments.
9.6 Prices listed on hugovitamin.com are exclusive of taxes.
9.7 In the event that you submit multiple orders, you have the option of choosing between making a single full payment or agreeing to pay in 4 (four) monthly instalments for each individual order.
9.8 You need to know that once you submit an order to Hugovitamin it is not possible to change that order on the website. For any change after the order is submitted, you need to contact the Hugovitamin Service Center via email to hugolobodad@gmail.com or by phone at 1-747-774-6999.
9.9 All products are subject to availability. Hugovitamin reserves the right to impose quantity limits on any order, to reject all or part of any order, and to discontinue products without notice, even if you have already placed the order. The Company will, of course, reimburse you for any product not received as a result of any of these circumstances.
9.10 You can manage your own order activity by setting up a personal My Account on this hugovitamin.com website.
9.11 If you purchase directly from hugovitamin.com, you will be assigned to one of our local independent partners who will be available to assist you with information about our products or with any of your other customer service needs.
10. Shipping and Delivery
10.1 Any special shipping delivery requests you make will only be honored when that request has been expressly agreed to and confirmed in writing by Hugovitamin. You acknowledge and agree that only deliveries and dates confirmed by Hugovitamin are binding, except if clause 10.2 below applies. Hugovitamin may choose shipping methods at its own discretion.
10.2 You understand and agree that you will not hold Hugovitamin liable or responsible for any delay in delivery that occurs due to unforeseeable circumstances or events beyond the reasonable control of Hugovitamin (“force majeure”).
10.3 You acknowledge and agree that Hugovitamin is no longer responsible for your product delivery once the product is delivered to the address you have indicated.
10.4 Our regular shipping charges are included in the product price you pay. If you request another method of shipping and we agree to it, we may need to apply additional shipping costs.
11. Payment and Other Charges
11.1 You can pay Hugovitamin product orders and application fees using the following payment options: Visa, MasterCard, Discover, American Express and Bank Draft.
11.2 Your payment is processed once you have submitted your order to Hugovitamin.
12. Returns
12.1 Hugovitamin is proud of the quality of its Products and certifies that the Products meet high regulatory standards for consumer use. However, if a Customer is not 100% satisfied, the Customer may return the product within six months of the ship date for a full refund.
12.2 Ongoing Orders (second shipment and beyond) must be returned in resalable condition within 6 (six) months of the ship date.
12.3 Ongoing Orders may be canceled at any time during the instalment payment cycle. Any outstanding payments at the time of the cancelation will be collected at their appointed time during the original payment schedule.
12.4 Hugovitamin will refund the Order on the same payment method that the Customer used for the purchase.
13. Communications Related to Your Order
13.1 By submitting an order, you agree to receive Hugovitamin commercial communications regarding your order in the form of electronic email, texts, newsletters, etc. using the contact details you provide us in accordance with our Privacy Policy.
14. Enforceability and Disputes
14.1 If individual parts of these Terms of Use are declared wholly or partially invalid or ineffective, the other clauses shall remain in effect.
14.2 Any modification or addition to these Terms of Use requires the written consent of Hugovitamin.
14.3 These Terms of Use will be governed by and construed in accordance with the laws of the State of Tennessee. For any dispute that the Parties are not able to resolve informally, the Parties agree that the dispute shall be submitted to the jurisdiction of the state or federal courts located in Shelby County, Tennessee, where the global headquarters of the Hugovitamin Company is located.
15. Liability
15.1 You agree to read the product label before consuming any Hugovitamin product, and to comply with any measure required to avoid any harmful consequence, including but not limited to cases of special health and/or physical conditions. You agree to give Hugovitamin prompt notice of any problems you encounter with a product and to cooperate with Hugovitamin in any investigation of your claims.
15.2 Even though we make a concerted effort to keep hugovitamin.com free of computer viruses, we cannot guarantee that this is always possible.
